These Terms of Service (“Terms”) govern your access to and use of websites operated by Hello Skin Franchise LLCand Hello Sugar Franchise LLC, including www.helloskinmd.com, www.hellosugar.salon, related subdomains, mobile applications, and communication platforms (collectively, the “Services”).

By accessing or using the Services, you agree to be bound by these Terms. If you do not agree with any part, you may not use the Services.

1. Franchisee Independence

Many Hello Skin and Hello Sugar locations are independently owned and operated franchise businesses. While these Terms apply across the HelloSkin and HelloSugar systems, your relationship with a specific franchisee may be subject to additional terms provided by that franchisee.

Franchisees are solely responsible for their own operations, including employment, services, and local compliance. The franchisors are not responsible for the independent acts or omissions of franchisees.

2. Use of Services

You agree to use our Services only for lawful purposes. You may not:

  • Misuse the Services or attempt to interfere with security features.

  • Copy, modify, or distribute content without authorization.

  • Use the Services in a manner that violates applicable laws.

3. Communications & Marketing

By creating an account, booking services, or providing your contact information, you consent to receive transactional and promotional communications, including:

  • SMS/Text Messaging: Appointment confirmations, reminders, promotional offers, and updates from Hello Skin and Hello Sugar. Message frequency varies. Message and data rates may apply. Consent is not a condition of purchase. Reply STOP to unsubscribe, HELP for help.

  • Email Marketing: Newsletters, promotions, and service updates. You may unsubscribe at any time.

4. Payments & Transactions

  • All payments are processed through secure third-party providers.

  • We do not store full credit card information on our servers.

  • Prices and promotions are subject to change without notice.

5. Third-Party Services & Links

Our Services may include links to third-party websites or integrations with third-party services. We do not control or endorse such services and are not responsible for their content, practices, or policies.

6. Arbitration Agreement

You agree that any dispute, claim, or controversy arising out of or relating to these Terms, your use of Hello Skin or Hello Sugar services, or your relationship with us shall be resolved exclusively through binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules.

  • Arbitration will take place individually, not as part of a class action.

  • Arbitration may be conducted remotely or in the city/state where services were provided.

  • Judgment on the award may be entered in any court with jurisdiction.

You waive any right to a jury trial or class action against Hello Skin or Hello Sugar.

7. Limitation of Liability

To the fullest extent permitted by law:

  • Hello Skin Franchise LLC, Hello Sugar Franchise LLC, and their affiliates shall not be liable for indirect, incidental, or consequential damages.

  • Our maximum liability for any claim related to the Services is limited to the amount you paid for the service giving rise to the claim.

8. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Arizona, United States, without regard to conflict of law principles.
